What a fee schedule should cover
- Retainer: the amount due before work begins, whether it is refundable and how it is applied to later invoices.
- Review: the rate and unit for reviewing records, research and drafting reports.
- Deposition: preparation and testimony rates, minimum blocks and who pays (usually stated in writing before the date).
- Trial: preparation and testimony rates, and whether a day or half day is the unit.
- Cancellation: the notice period and what is charged for reserved time cancelled late.
- Travel: whether travel time is billed and which expenses are reimbursed at cost.
- Payment terms: invoice timing, due dates and what happens to unpaid balances.
Before you send it
- Put the schedule in a written engagement letter with the retaining party.
- Keep your fees independent of the case outcome.
- Check any court rules that apply to expert fees in the jurisdiction.
